Supplier – SpeakUp | Language Center, which sells language courses, textbooks, and other related products.
Client – An individual or legal entity that purchases products or services from the Supplier.
Product – Educational literature, branded merchandise, and other related items.
Course – A short-term or long-term English, Russian, or Georgian language course, provided either online or offline.
1. General Provisions
1.1 – The products available in the Supplier’s store include foreign language courses, textbooks, and branded merchandise, each of which is subject to different pricing based on its specific characteristics.
1.2 – The Client may purchase one or multiple products. The total amount payable shall be indicated in the invoice, which the Client will receive by email after completing the order.
1.3 – Prior to making any payment, the Client is required to contact the Supplier to verify product availability (including available places in course groups and schedules, where applicable) and delivery options.
2. Product Delivery and Return Terms
2.1 – After confirming product availability, delivery options, and payment details, the Client is required to make payment either in cash or via non-cash payment methods. Upon payment, the ordered items shall be delivered to the address specified by the Client or collected in person from the designated location.
2.2 – The Supplier undertakes to deliver the ordered products to the Client in proper and defect-free condition.
2.3 – Delivery within Tbilisi shall be completed within 2–3 business days, while delivery to regions shall be completed within a maximum of 4–6 business days.
2.4 – The delivery fee for products weighing 1–5 kg is set at GEL 5 within Tbilisi and ranges from GEL 9 to GEL 12 for regional deliveries. Delivery fees for products of different weights may vary accordingly.
2.5 – Due to unforeseen circumstances (including adverse weather conditions, poor road accessibility, natural disasters, or similar events), delivery timeframes may be unilaterally amended by the Supplier.
2.6 – Upon receipt of the product at the delivery address, the Client is obliged to immediately inspect the product for any technical or visual defects.
2.7 – The Client has the right to request the replacement or return of a product purchased either in-store or online if the product is defective or if its actual characteristics do not correspond to the technical specifications published on the Supplier’s website.
2.8 – The Client must notify the Supplier within one (1) business day from the discovery of the defect and present the purchased product on-site along with the fiscal receipt or other valid proof of purchase. The Client is also required to substantiate the existence of the defect.
2.9 – A product shall not be eligible for return or replacement if it contains only minor or insignificant defects.
3. Course Delivery and Return Terms
3.1 – After agreeing on the course level, schedule, and format of study, the Client is obliged to make the payment, after which the Supplier shall ensure the delivery of the course either on-site (address: Tbilisi, Dighomi Massive, Block 5, Building 1A) or online.
3.2 – Any classes missed by the Client during the course shall not be subject to rescheduling and/or adjustment of the paid fee.
3.3 – Classes missed due to the Client’s fault and/or early withdrawal from the course prior to its completion shall not release the Client from the obligation to pay the remaining balance, if any outstanding amount exists.
3.4 – Classes missed due to the Supplier’s fault shall be compensated according to a mutually agreed schedule.
3.5 – In the event of force majeure, the Supplier reserves the right to replace the assigned instructor and/or transfer the Client to a group appropriate to the Client’s knowledge level and age in order to ensure proper service delivery, based on the available balance.
3.6 – In cases of force majeure where the Supplier is unable to compensate missed classes or unable to commence the planned course on the predetermined start date, the Supplier undertakes to appropriately adjust the fee or fully refund the amount paid to the Client.
4. Data Protection Policy
4.1 – The processing of personal data of data subjects by the Supplier shall be carried out solely for lawful purposes and only to the extent necessary to achieve such purposes.
4.2 – SpeakUp | Language Center, in accordance with the legislation of Georgia, processes clients’ personal data for the purpose of providing services, conducting retail sales, and, where the client so consents, for marketing purposes, including the delivery of promotional and marketing communications.
4.3 – For the purposes stated above, SpeakUp | Language Center processes personal data such as first name, last name, personal identification number, phone number, email address, and residential address.
4.4 – Where required to fulfill legal or contractual obligations and based on a valid legal ground, personal data may be shared with parties involved in a transaction and/or other third parties with the consent of the data subject (e.g., courier or delivery service providers).
4.5 – The Client has the right to request the termination of processing and the deletion of their personal data from the Supplier’s database, in accordance with applicable law.
5. Amendments and Term
5.1 – The terms and conditions set forth in this document are binding upon the Parties and shall remain in force for an indefinite period.
5.2 –The Supplier reserves the right to unilaterally amend this document and its terms at any time. Any such amendments shall be published on the Supplier’s official website, which the Client may access at any time.
5.3 –Any matters arising between the Parties that are not regulated by this document shall be governed by the terms and conditions of SpeakUp | Language Center and in accordance with the legislation of Georgia.
